Part 1: General Regulations

Clause 1: Applicability and Contract Formation

1. Services Offered: Hostingot, referred to as the "Provider," operates through its online platform at https://hostingot.com (Online Shop) and provides various hosting services.

2. Scope of Terms: These General Terms and Conditions (GTCs) govern all contracts between the Provider and the customer through the Online Shop and any other agreed contract outside the Online Shop.

3. Customer Terms: Any customer terms deviating from these GTCs are not recognized unless explicitly accepted in writing by the Provider.

4. Individual Agreements: Specific agreements made during orders take precedence over these GTCs, supplementing areas not covered by them.

5. Target Audience: Services are for both consumers and businesses unless stated otherwise. A "consumer" is defined as a natural person engaging in transactions outside their main business, while a "business" operates within their business scope.

6. Future Contracts: For businesses, these GTCs automatically apply to future agreements unless explicitly stated otherwise.

7. Order Process: Customers place a binding order by clicking "Order & Pay" in the Online Shop. Confirmation of receipt does not equate to contract acceptance, which occurs upon delivery of service access data.

8. Languages: Contracts may be concluded in English or German, with the German version taking precedence if discrepancies arise.

9. Contract Storage: The Provider will store relevant contractual provisions.

10. Amendments: The Provider may amend these GTCs to accommodate legal or technical changes. Customers will be notified via email and amendments will be considered accepted unless the customer objects in writing within six weeks.

Clause 2: Provider Services

1. Service Scope: Detailed service descriptions are available in the Online Shop.

2. Server Locations: Customers can select their preferred server locations. If opting for non-EU locations, EU Standard Contractual Clauses may be agreed upon.

3. Third-Party Services: The Provider may deliver services via in-house personnel or third parties, with customer cooperation required as needed.

4. Service Adaptation: Services may be updated to reflect technical or legal changes without altering agreed service scope or quality.

5. Dedicated Servers: Customers are bound to use a device fitting the product category ordered, with the Provider determining hardware features. IP addresses may change for technical or legal reasons.

6. Data Backup: The Provider's obligation to back up data is tied to explicit agreements within the service description.

7. Additional Services: Free services can be altered or charged after giving customers adequate notice.

8. Technical Support: Support is limited to what is contractually agreed upon, with no direct support for customers' clients unless agreed in writing.

Clause 3: Customer Responsibilities

1. Required Information: Customers must provide accurate details including contact and domain information.

2. Accuracy Warranty: Customers guarantee the accuracy and completeness of the data provided.

3. Data Updates: Customers must update the Provider promptly regarding any changes to their information.

4. Verification Rights: The Provider may request additional documents to verify the customer’s information.

5. Restrictions on Use: Contracts are not concluded with customers from specified countries, including North Korea and others. Violations may lead to legal actions and/or contract termination.

6. Sanctions Screening: The Provider conducts ongoing screenings for government sanctions and may refuse contracts based on outcomes.

7. Data Backup Obligation: Customers must regularly back up their data.

8. Compliance: Customers acknowledge that non-compliance may lead to contract termination and/or damages.

Clause 4: Payment Terms

1. Payment Schedule: Payment due dates depend on the service and contract duration, with the full amount or installments due as specified.

2. Payment Methods: Accepted payments include bank transfer, credit card, PayPal, Skrill, and SEPA direct debit for EU customers, except for first-time payments.

3. Currency Flexibility: Payments can be made in available currencies, fixed upon contract start.

4. Debit Authorization: Authorized payment methods will be charged on due dates.

5. Refunds: Refunds will be processed using the original payment method, barring legal restrictions.

6. SEPA Pre-Notification: Customers using SEPA agree to a shortened pre-notification period of one day.

7. Service Activation: Service provision is contingent on full payment or first installment payment.

8. Additional Charges: Fees for services beyond the GTC scope are chargeable.

9. Price Adjustments: The Provider can adjust prices with customer consent, enabling a special contract termination right should customers disagree.

10. Tax Changes: Pricing adjustments due to tax changes are permissible.

11. Penalty Fees: Costs from rejected payments are billable unless demonstrably inaccurate.

12. Default Measures: Services may be suspended for payment defaults, with potential data loss and reactivation fees.

13. Creditworthiness Checks: Address verification and credit checks may be performed at the customer's expense when necessary.

14. Miscellaneous Payment Terms: Payment obligations not covered above adhere to invoice terms without deductions.
